In an effort to better understand the challenges facing safety managers across the country, the JJ Keller Center conducted a survey of 172 such professionals, asking them about their biggest PPE-related obstacles.
The most commonly cited PPE challenge was not cost, functionality, or availability – instead, it was getting employees to wear their PPE in the first place.
Eighty-three percent of respondents said they often have issues with employees wearing their PPE, with another 8% saying they sometimes do. The most common reason why, according to these safety professionals, was that their employees “just didn’t want to wear it” (72% of respondents) with another 52% saying they have had workers say they “didn’t think it was necessary.”

7 Things You May Not Know About OSHA Inspections
OSHA Conducts 35,000 Inspections per Year
Throughout the year, OSHA conducts approximately 35,000 federally mandated inspections. This number jumps to 60,000 in states with approved OSHA state plans. And, given the recent proposed increase to the OSHA budget that is likely to come into effect for the 2023 fiscal year, it’s reasonable to assume this number will continue to rise. Most of these inspections are done without notification.
Very Few OSHA Inspections Find 0 Violations
Most OSHA inspections are triggered by negligence, employee complaints, injuries, or industry focus. Nearly all inspections reveal at least one violation.

Increased OSHA Budget Proposed by Senate
OSHA Fall-Protection Budget
Fiscal year 2023 is likely to see an increase in federal funding for OSHA. The new budget will, in all probability, land somewhere between $679 and $712 million — at least a $68 million increase from 2022’s budget of $611 million.
This money will be used in a number of ways, including the hiring of as many as 500 new employees — 179 of which are likely to be inspectors.
This is good news, from a safety perspective: the increased budget and enforcement of OSHA compliance regulations will lead to safer work environments and fewer jobsite injuries. This also means, however, that companies need to remain vigilant about their safety planning. The added number of inspectors will of course lead to increased jobsite inspections; thus, companies need to be proactive as opposed to reactive.

Passive Fall Protection
Also, do your research to learn why passive fall protection has far fewer OSHA-compliance concerns than its active fall-protection counterpart. Among the many benefits of a guardrail-based system is its simplicity: simply install it and leave it. With harness-based systems, the user must constantly be interacting with the equipment: from training and maintenance to inspections and replacement. This is to say nothing of the compliance concerns: with safety rails, you know you’re fully in compliance at all times. With harnesses, compliance depends upon the organization and the user properly using the equipment (which requires costly training and ongoing education).

OSHA Compliance vs. Cal-OSHA Compliance
DID YOU KNOW THAT CALIFORNIA’S FALL-PROTECTION STANDARDS ARE MORE STRINGENT?
While reviewing your facility’s fall-protection options under federal OSHA compliance, California residents should also be asking themselves: is it Cal-OSHA compliant? The rules between the two regulatory organizations differ, with California demanding more of safety and facility managers with its stricter standards — especially when it comes to guardrail codes.
There are a number of distinctions between OSHA standards and Cal-OSHA standards pertaining to general industry, starting with the height of the top rail. Federal OSHA regulations require the top rail to be placed 42” above the walking surface, allowing a +/-3 vertical tolerance — this means the top rail can be placed anywhere between 39” and 45” above the walking surface (1910.29.b.1). Cal-OSHA, on the other hand, requires the top rail to be positioned at least 41” above the walking surface (3209.a).
The maximum length of a single railing also differs, with federal OSHA standards allowing 10-foot rail length between stanchions versus the 8-foot maximum rail lengths required by Cal-OSHA (3209.c).
Finally, the force requirements are far more stringent under Cal-OSHA regulations than those enforced by federal OSHA standards. Federal guidelines require a single railing length to withstand 200 pounds of pressure (1910.29.b.3). Cal-OSHA instead measures force based on linear foot, requiring 20 pounds of force to be withstood for every linear foot throughout the entire length of the rail system (3209.b).

Fall Protection: OSHA’s Most-Cited Violation
As it does every year, OSHA has released its 2021 top ten list of most-cited workplace violations — and, for the eleventh time in a row, failure to have appropriate fall protection (1926.501) ranks number one.
With 5,271 violations, fall protection more than doubled the second most common violation (respiratory protection), which had 2,521 citations. Likewise, lack of proper fall-protection training (1926.503) also made the top ten list with 1,670 violations. And, using the average OSHA fee for this particular citation (just over $5,400), the yearly national penalty for lack of fall protection totaled more than $28 million (to say nothing of the additional $2.7 million collected for lack of fall-protection training).
